Legal Question in Family Law in Indiana

My husband has a court order stating that he is to pay $50 in child support since 2008. He is the noncustodial parent and does not claim his daughter on taxes. He also pays half of the day care bill which is not factored into the child support. A lawyer contacted us about support modification and we had no idea this is usually done every year. We have two children that we support here and we don't have a lot of money. His ex was also wanting us to pay half of her full day kindergarten school bill which came out to be about 750 dollars and also whatever half of the YMCA aftercare bill will be which we don't have a problem paying. We would rather not pay the kindergarten bill because half day kindergarten is free and it is not our choice to put her in full day. Our agreement states that they are supposed to come to an agreement on these types of issues but we are co-parenting with a sociopath and that never happens. So, are we responsible for the school bill? And also, she has a live-in boyfriend. Does his income factor into the child support worksheet?

First of all, there is no law that states child support should be modified every year. Your income is not considered in child support, so the live in boy friends should not be a factor either.You and your husband should read the Indiana Child Support Guidelines and commentary and determine after reading those, whether you should contact an attorney in person.
