Legal Question in Family Law in Indiana

My husband and I are currently going through divorce proceedings. We have a daughter who I have relocated to a neighboring state with upon the agreement of monthly custody visits. I have been waiting 2 months for his lawyer to draw papers for the interlocking period setting custody and visitation. I agreed to monthly weekend visits if they are supervised at night by his aunt due to the medication he takes and my concern that he sleeps to heavily and does not hear her. With his lawyer dragging his feet to get these papers submitted to the judge he has not had 3 weekend visits that are unsupervised at night. Is this something that is going to work against me when we go to court for our "final" date in December, or will it help me since he is non compliant to the verbal agreement? Also, how do I prove that he is not being supervised at night?

Also when I ask my attorney questions about my case, he does not give me straight answers and will take up to 2 weeks to return my phone calls. I also am not recieving copies of motions submitted to the court or papers being served to my attorney's office from my husbands. I just want to be informed of the status of my case, be moving in a forward direction, and be prepaired for court, but I'm not sure that my attorney is helping me do this.

Your attorney is in the best position to give you advice here. If you are not satisfied with your attorney even after asking these questions, look for a new one who can communicate with you better.
