Legal Question in Family Law in Indiana

My husband and I live in the state of Indiana. He was born in Cook County, IL. When his birth certificate was completed, his mother put his last name as the father's last name followed by her last name, for example "Garcia Rodriguez". His mother, in filling out his birth certificate assumed the process was the same as in Mexico where the child takes both parents last name.His social security card list only his fathers last name, "Garcia". He has always used only his father's last name. Recently in renewing his license in the state of Indiana, for some reason they listed his name as, "Garcia Rodriguez". The motor vehicle bureau will not change it back to only reflect, "Garcia" because that is not what his birth certificate says. We have lived in Indiana for more than ten years and this is not the first time he has had to renew his license, so we are confused on what the issue is exactly. So now we need to find out how we go about correcting the birth certificate. Additionally his father's name needs to be added to his birth certificate as it is not. Thank you for any guidance provided.

You should contact the Department OF vital Statistics in cook county and see if they have a procedure. You may also need to hire counsel in Indiana to file for a name change.
