Legal Question in Family Law in Indiana

My husband has "physical sole custody" of his two sons. Per the custody agreement, the mother should be allowed "reasonable visitation". The mother has not made any attempt in the past three months to see the boys, nor has responded to any of our attempts to find out why. Is there a process that can be started without the cooperation of the mother that relinquishes her parental rights? If so, how do we begin that process. My husband would like me to adopt the boys, so if anything were to happen to him, the boys would still be well taken care of. We live in indiana and the mother lives in illinois. Illinois is also where the custody agreement was filed. The mother also gave up her physical custody voluntarily.

This is a bit soon for a court to take away her rights without her consent. I suggest that you contact a local attorney to discuss strategy.
