Legal Question in Family Law in Indiana
My husband has primary physical custody of his two children and they share joint legal custody. He is a Electrician that has been off work for almost 2 years due to the economy. He has a job offer in Texas, we live in Indiana. Can he go work in the other state, which would help our family of 7 greatly, and the kids stay with me or does he have to give her back the children? She is very active in their lives- takes her 1 day a week visit and every other weekend and is current on her child support. She is very vindictive and manipulative and is always looking for a way to burden us financially. She has taken us to court for custody before and sent the notice to old addresses and tried to get the court date past us, we found out the day before the court date. We are concerned she would try to do the same again or get them for a visit while he is out of state and not bring them back. You never know with these kind of people. Can the kids stay with me here with their step-sibilings? Thank you for your time!

There are no guarantees and your best bet it to have a full consultation wiht a lawyer. However, as long as you are an adult member of his household and his move is not permanent, you should be o.k.- that is not to say that she wont try to modify, so be sure to consult with an attorney.
