Legal Question in Family Law in Indiana
My husband just recieved papers in the mail for a child support court date. 7 yrs ago he slept with a girl, she told him she might be having his kid and then he didnt hear from her. The Aunt has him and another kid that she had later,but both kids have the moms last name, but she doesnt have either of them. Is it possible for us to be granted custody or since hes been there with the Aunt for seven yrs would she get custody over my husband(his Dad). We have been really upset about this and he feels like hes missed out on so much and I would think he would have rights over the Aunt but were not sure. Im trying to decide if we would need a lawyer for this upcoming court date.

You have a chance at custody. However, the issue is not about your husband, but rather what is in the best interest of the child. I had a similar case many years ago and ultimately the father did obtain custody over the mother. It took a couple of years. You need to hire counsel!
