Legal Question in Family Law in Indiana

Husband walked out

My husband of 32 yrs. walked out the other night. Leaving me with our 28 yr old disabled son, I only have a part-time job and do not make enough money to support the two of us.

My question is: What legal things do I need to do first?

How do I handle cars and bills that have both our names on the contract?

Well the courts think it was OK for me to sell some of his things to provide me with money to pay our bills?

Should I get a ''legal'' seperation so he can not just walk in and out of our home when he wants?

You need to get a divorce filed. Skip the legal separation idea. Since you are in Indianapolis, you might give Legal Aid a call. Before you start selling things, I suggest you read this article on my blog: http://haslerlaw2.blogspot.com/2007/02/maintenance.html

Re: Husband walked out

You need to hire an attorney as soon as possible. You can probably get an emergency hearing since you have a disabled child and obtan an order requiring your husband to pay maintenance on a temporary basis at that hearing. Ultimately, you will probabaly be ableto obtain permanent maintenance if you are unable to work full time due to the disabled child.
