Impute on child support

My ex-husband cannot keep a stable job, he will not get an education(I have a statement that he said he was afraid to get an education because I might take him to court for more support) and he has had 4 years to get an education. Can the courts adjust or impute his support obligation based on a wage he could be making if he had gotten a license or degree?

I assume from your question he was in school when support was last set and after an opportunity to complete a 4 year degree, he simply does not yet have a degree. It is plausible that a judge would look at his educational pursuits and determine that he has not made a good faith effort to complete his degree and impute income so that his support could be increased. It is unlikely the amount to be imputed will be as much as a degree holder would earn and you would have to have evidence of what a degree holder would earn. I would not recommend that you get your hopes up, but it is worth bringing this matter to the court's attention.
