Legal Question in Family Law in Indiana
Incorrigibility forms filed on 16 year old
My 16 year old neice started seeing an 18 year man who was kicked out of school for being a sexual predator. we found out he was coming to the house between 1 and 4 am. My sister filed a protection order on him. The judge immediately. My sisters ex husband is allowing the 16 year old to see this man when she visits her Dad on weekends. We have video tapes of the girl making the statements that she sees him every other week end when she goes to her fathers. She is saying she wants to die, writes poetry about suicide, and threatens to move to her fathers house. My sister filed incorrigibility forms to get help for my neice but the prosecuting attorneys office said they can't help at this time. Do you have any ideas how we can get my neice some help? She refuses to obey any rules at home, wants to constantly argue, and verbally abuses the other two children in the home. There is more. My sister needs help. She is in therapy but it isn't doing any good. I am concerned about the suicide poems and threats to slice her wrists.
Thank you

Sounds to me like there needs to be a complaint for the violation of the protectiver order. Additionally, there should a Motion to Modify the Visitation that the father has.

There is very little you can do. Mother is the custodial parent. It seems that father is not keeping daughter from the 18 year old. Mother can ask the court to stop visitation, enforce the protective order against the 18 year old, and it sounds like she is trying to file incorrigibility with the prosecutor's office. Mother might try to get a doctor's evaluation for the child - if she is as suicidal as you think - for a mental health commitment. However, these are all things that only mother can do.
