In an Indiana Child Custody battle, A one month old baby girl, whose biological father is a child molestor, can that be held against him if the charges stemmed over ten years ago and was when he was a minor? but, keep in mind, he was waived to adult court, and plead guilty.

Anything "can" be considered in a custody dispute. This fact reflects equally poorly on both parents, if the mother was aware of his past.

That is absolutely a factor and should be mentioned to your attorney. The court needs to be aware of this fact. It will not mean that father cannot have visitation rights, but it might be the one factor that would tip the scales in a custody dispute, all other things being equal.
