Legal Question in Family Law in Indiana

joint custody and child support

If my daughters mother and myself agree to joint custody can we agree on no child support for either of us? also when we go forward with the joint custody what if anything can I do about the arrears I have? can we agree that they are up to date or is there a way that we can agree that there are no arrears although they have been established already in the court? we have agreed to joint custody outside of court so far but have no clue about the child support issues. We would also like to do all of this without a hearing, is that possible? possibly both of us going to one attorney.

Re: joint custody and child support

You certainly want a lot here. Absent fraud, the arrears are the arrears. Under certain circumstances, if you have joint physical custody the court will order no child support, or a very reduced child support, keeping in mind that you would have a credit for overnight parenting time 183 days a year. An attorney can only represent one party.
