Legal Question in Family Law in Indiana

keeping the house

I have a male friend who is wanting a divorce, but wants to keep the house and his son. The wife has a house which was left to her after her parents past. I has no note due on it.

She does not have a job to pay on the house that are in now. She does not pay for anything now. He pays all the bills and he furnished and remodeled the home all by his self. And as far as their kids go, she has no patient with their 3 yr. old son. She never wants anything to do with him. And he just joint custidy for their daughter, she is only 2 wks old. This was not something he wanted, it was a

surprise. He wants to file for a divorce but doesn't want to lose everything he's worked so hard to get. Can you please give us the answer on what to do?

Your friend needs to consult a lawyer to find out in your locality how the courts generally rule on such cases. It seems he wants custody of one child but not the other. Some judges tend to favor a non-working spouse, while others look at the dissolution of the marriage as a business proposition where everything is 50/50 in terms of assets owned.
