Legal Question in Family Law in Indiana
l have lawyer for my divorce right now, here in lndiana, and married for fourteen years, but he told me l can only get 40% of 401K co'z may be i worked also for 13 years and get 401K since 1999 until l terminated last May, 2009 and 50% of my husband pension never mention about Social Security law about divorce for husband and wife and he told me not sure if i get 50/50 in the house or nothing co'z my lawyer said my husband bought it one year before we married and never put my name on title, the house is already paid off by my husband. Do you think i need to stay with this lawyer? On yellow paper he said he had 30 years experienced in divorce, but l feel he cannot fight for me. l paid him already, and don't know lf i can't afford to get another lawyer, please help me. I cannot really understand all of your submission. However, he general rule is that there is a 50/50 split-the fact that your husband never put the home in your name is not determinative of what you obtain, regardless. Your attorney has an obligation to advise you of all possibilities as there are many factors that contribute to a determination of property division .
