Legal Question in Family Law in Indiana
Does anyone know the laws for signing over parental rights in Indiana?
I am pregnant and the father of the child wants to avoid court. He has offered to sign over parental rights and offered to deposit money into an account to help me. He cannot be trusted to help support this child without a court mandate any way you cut it though. He is simply trying to avoid court for personal reasons. I receive TANF and Medicaid for my first son and the second will likely be the same. TANF requires me to turn in a name for child support anyhow. Is it even legal for him to just sign over rights and not be obligated by law to pay child support to help? Can he only sign over his rights if I am married and the child is going to be adopted by my husband? What are my options to make sure he still helps me with the baby. I am not trying to get a bunch of money just help with the child. I have heard so many things and need to get to the bottom of this situation.

He can not just sign over rights. You are right about the adoption, etc. In order to insure an obligation, you need to obtain a court order for child support.
