Legal Question in Family Law in Indiana

Legal Guardians want to adopt granddaughter

Is it possible to adopt our granddaughter? She has lived with us for over 3 years (we got her at 10 months old). Her parents won't take care of her so she was taken from them. We know her mom would not agree if asked about consenting. Is there any way to adopt without her consent? Our son would agree to it because he knows they can't take care of their daughter. Our granddaughter sees her parents every once in awhile but there is no real connection to them or they to her. I just need to know if there are any possibilities? (Her parents are 23 and 24 yrs old and not together).

Re: Legal Guardians want to adopt granddaughter

The state can force the severing of the parents' parental rights.

I assume that the state was involved, if the child was taken from her parents.

Therefore, I would suggest you talk to your county's office of family and children and try to find out if that is a possibility.

You can try to do it privately, if the parents haven't paid to support the child and the contact has been non-existent or sporadic. It's always easier to do it by consent, but sometimes it has to be done the hard way.

I would need to know a lot more about the background to give you a more specific answer.

Hope this helps a little...
