whats legal for non custody of a child?

neither I, nor my boyfriend have custody of our 18 month old daughter... i am moving in 2 weeks back home to CA w/ my mother, can he legally stop me from taking our daughter w/ me? what can or should i do to begin custody?

Unless paternity was established in court or by affidavit, your boyfriend has no rights. However, once he or you file for paternity, he can ask for custody. He will also be required to pay support if you end up being the custodial parent. You need to hire an attorney as soon as posiible.
