Am I legally separated?

I have been living apart from my husband for the past nine months. Due to finacial problems, neither of us have filed anything with Indiana courts, are we "legally separated" in the eyes of Indiana law?

No, in Indiana, the date of legal separation is the date of the filing of a petition for dissolution of marriage. One item that could cause you trouble by not going foreward with your divorce is that under Indiana law a spouse is liable for the reasonable and necessary expenses of the other spouse. This means that if one of you, for example, get sick or injured and requires medical help, the other spouse could find themselves liable for those bills, even though they know nothing about them and never consented in any way.
