Legal Question in Family Law in Indiana
I live in Indiana. I am going to be pursuing a divorce from my husband and he is starting crap this week because our son is starting daycare this week. he now all of a sudden doesn't want him going to daycare for 2 days a week. I have already paid for the first two weeks of daycare. Can he do this? He now says he is going to get a car seat and start driving him his mother's house and he has never taken our son anywhere. My husbands mother is probably behind this because she is so distraught that he is going to daycare. she believes he will get molested. can he do this? I don't even know if this is a legal question.

If there is no pending legal action, than the two of you are no different than any other married couple arguing about a child's whereabouts. No one has superior authority to control what happens, whether day care is paid for or not. Either of you can have the child wherever you want to, and there is no involvement of the law to decide what happens if you disagree unless there is a pending divorce or separation action.
