Legal Question in Family Law in Indiana
Malpractice attorney
Help - Surely there are attorneys that stand by their word!!! I went thru a two and half year divorce proceeding. My ex started selling our rentals to relatives for nothing. Then he withdrew all money out of our accounts. He said he found a better bank. I filed for divorce just to freeze everything, I was afraid i wouldn't be able to find any of the money. When I hired an attorney, I explained how tricky my ex was and that I didn't have any money, stay-at-home mom, no income. I explained how my ex laughed at me getting anything. (I was married 21 years). The attorney accepted my case, i borrowed $5000 from my mom for him. He said under these conditions he would make my ex pay for his fees. Well my ex jerked everybody around for two more years. In the end I got screwed, and had to pay for more than $40,000 in attorney fees. Plus now, I even found three mistakes he made in the settlement. Can he be liable for my loss?

Re: Malpractice attorney
Malpractice is a very serious issue and requires detailed analysis that goes far beyond what this forum can provide to you. For example, what loss are you referring to and how was that loss a result of the three mistakes? What are the three mistakes?
Was there a contract wherein the attorney agreed to accept your $5000 and would receive the reminder of the fee from your ex.? Most attorneys have a contract that state that the client is ultimately responsible and that the attorney will try to obtain reimbursement of the fees for the client.
I suggest that you see an attorney in person and have your details of the mistakes and how they caused your loss. You should have a copy of the agreement with you Additionally, since you did not give a time frame, you should see an attorney immediately in case there is any post-decree relief available.
Good luck
