Legal Question in Family Law in Indiana

Is my marriage legal

I married this man in 1982 and we had a child in 1985. A few years later he suffered a heart attack and had to file for social security disability. He was told to produce a birth certificate. It was then that he told me that the name I had always known him under was not his legal name. He changed it himself without ever going to court to have it legally changed. He had to go to court then and have it legally changed to the name he had been using in order to get his disability . We were never remarried after that. My question to you is, are we legally married? Our state does not recognize commonlaw marriage as being legal.

Re: Is my marriage legal

Can not say I have seen a question like yours before. My opinion is that you are legally married, you married the person not the name. You should hire an attorney to research this and give you a detailed opinion.

good luck
