I am married to someone who is not the biological father of my son, am I considered his only legal guardian? Or would my husband be considered his legal guardian, too?

1. Has a court determined paternity?

2. If so, then what does your decree say? If not, was your son born during the marriage to your husband?

3. If your H is not legally the father, then unless your H adopts your son, or a court makes him guardian INSTEAD of you, assuming there is no legal father, than your current husband has no rights in the matter.
