Legal Question in Family Law in Indiana

I am married to a convicted child molester. He spent 3 yrs on prison. We have been separated for 2 yrs, but we are still married. I had a baby recently with another man. My husband and I want to work it out and get back together. We have an 8 year old son. Can the father of my new baby take the baby away f rom me? Is there any way I can be with the convicted man and not lose my son? He was out of prison before I even met him, and he hasnt got into any trouble since. He does have to register. Thanks.

You are looking for black and white answers here, and none exist. Living with a convicted child molester is one factor that can be used in determining custody, but it is not the only one. You need to talk to a family law attorney in your community to share all the facts and get a complete answer.

Jay is right. It is one of many factors the court will consider in determining whether it is in the child's best interest for you to have custody while living with a convicted child molester. You definately need to hire counsel.
