We were never married and she has custody, never been in court for that issue-she had boyfriend move in home where my daughter lives, he has an open case in court on 4 class D Felony Theft Charges and 1 on Possession of Paraphernalia can I as the noncustodial parent have him removed from the home and not be able to be around my daughter.

No, you cannot have him removed from the premises. Rather, you can petition the court for modification of custody and possibly have the child removed to your custody, or ask the court for an order forbidding her to have the boyfriend in the household. However, based on the information provided, I have some doubts as to whether the latter would be granted. You need to hire counsel locally.
