Legal Question in Family Law in Indiana

Not Married To Father - Child Support Request After 17 Years

I have a 17 year old daughter. Her father is not named on her birth certificate. She was born in Illinois. We live in Indiana. Can I still get back child support for her and if so, what do I have to do to go about getting it. He knows she is his and so do I - paternity has never been verified.

Please advise.

Re: Not Married To Father - Child Support Request After 17 Years

You must file a paternity suit against the father in the county where you reside. There is a limit on the amount of "past due" support you can get, as Indiana law specifies that period of time to no more than 2 years maximum. It is mandatory to get support from the filing date to the date of the hearing. Any other support is optional at the discretion of the judge. It is unlikely that the judge would go back beyond the filing date due to your child's age.
