Legal Question in Family Law in Indiana

my ex and I were never married but have a 13 year old son together. I kicked him out because he was seeing another woman. My son wants to spend time with his dad but the other woman is always present and he doesn't want to be around her. We have only been seperated for 6 weeks. My ex was paying child support with out a court order but now refuses to since my son won't go around his girlfriend. my question is can my son be forced to spend time with this woman? He does want to spend time with his dad and I want him to also. His dad has never really spent time with him and they don't have much of a bond because of that.

He can be forced to spend time with his father. Unless the new girlfriend is harmful to the child, beating, kicking, calling vile names, etc., the court will not block it. If the two of you had been married, a court might be more likely to tell Dad not to have the new GF around while the child adjusts to the collapse of his parents' marriage, but that does not apply here.(No, you will not be able to convince a court that this was just like being married; only married is being married).

If you think there is this kind of harm, get your child to a counselor to sound it out.
