Medical/Genetic Information

Situation: A biological parent not involved in their biological child's life for over 30 years has been asked for medical/genetic information from said child. This biological parent has refused to furnish this information. It is possible to legally force them to furnish this information?

I practice law in Indiana, so I can answer in terms of Indiana law.

I haven't ever had to answer this question before.

My gut reaction is that no, you cannot force someone to divulge medical information because of privacy issues.

Unfortunately, you can't use the laws to make another person be a decent human being.

What you COULD do, though, is have an attorney write a letter, suggesting the reasons that the information is sought and asking the person to provide the information.

But my thoughts are that you probably cannot FORCE the person to do it.

All the applicable statutes of limitations have expired for the use of a paternity action to compel information from a biological parent. There is no remedy available to the child.
