Legal Question in Family Law in Indiana
Can military attorneys help in child support cases?
I joined the army 4 months ago and need to modify my child support because its based off a job I got laid off from two years ago in which I was making 3x what I am now. I had a consultation with a civilian attorney that said my army allowances can be used as income but all the recruiters and people in the military have told me that allowances should not be used. The attorney told me that the judge will go off state law (Indiana) and not federal.
Would getting a military attorney be in my best interest or to retain a civilian attorney?

You need both. Have the military attorney provide the code and case law to the civilian attorney.
I personally do not know the answer. However, it seems to me that national security comes first. So if there is a statute that applies to the military in terms of allowances, I would think that trumps state law.
