Military Pension and VA Disability

I was divorced from a retired marine in September, 2008. I was awarded 50% of his disposible military retired pay. He immediately filed for VA disability and received a 40% rating, dropping my portion of retired pay by over $200 per month. We are both residents of the state of Indiana. Is there anything I can do?

You should talk to the attorney who handled the divorce and see what she or he thinks. That person would be in the best position to know whether there are grounds to set aside the original order and give that attorney specifics when you say immediately filed. Good luck.
