Legal Question in Family Law in Indiana
Modification of child custody
My son has lived with me for over one year. His father has physical custody and I am wanting to modify custody. His father is contesting this and says that I will not get custody because I let my 14 year old son visit his girlfriend. She lives out of town and he stayed all night there a couple of times while her parents where there. This is the only thing he has against me, and I want to know if this will cause me to lose my case?

Re: Modification of child custody
Provided that your son was not sleeping with his girlfriend and there was adult supervision at all times, this is probably not sufficient to prevent a modification, epsecially if your son wants to live with you, and his father has allowed him to continue to live with you.
