Re: Modification of Child Support

By statute child support continues until a child reaches age 21 unless the child is emancipated prior to such age. If you think your adult children over 18 should be treated as emancipated you need to file a petition with the court where your divorce occurred or where paternity was established so you can get a hearing to explain to the judge why the children between 18 and 21 are self supporting. If a child is over 21, you might still need a petition to the court to get an order to stop an income withholding order to your employer. If you have an arrearage, the court will adjust the arrearage for the date of emancipation. If you are not behind, you can request the court to order the custodial parent to reimburse you.
