Modification for Out of State Visitation
I was divorced in July 1997. I lived in Indiana at the time. Even though the maternal family made it difficult, I was able to partially enjoy some of the visitation awarded me. In April of 1998 I prepared to move to Florida. I contacted my divorce attorney to file for a Modification of the Visitiation so my son could visit with me in Florida. I have had 5 court dates canceled as I have always been 4th or 5th or 6th choice. I was to have had 1st choice this last time, March 8, 1999. However, in January, my ex-wife's attorney passed away. His partner was unable to take over the case. Today, I called my attorney to go over points of the case and was told that we were once again canceled for May, 1999 as 4th choice! Is there anything I can do, file, whatever to assure my case being heard this time? I fear missing more time with my son. Help!

You are a victim of delays in the Court system. I am admitted in Florida and therefore cannot advise on Indiana law. Good luck.
