Legal Question in Family Law in Indiana

When modifying non custodial visitation what is considered a threat to a childs

My husband & I divorced 2 years ago, we have a daughter who is 5 & has Asthma. For the last 2 years of our marriage his other child would come to our house for week end visitation. Each time with head lice. I would always treat her & send her home clean. Now that our daughter & his other child are going to dad's every other week end our daughter is coming home with head lice. I have called environmental services on the other mother. I have tried to talk with her & my childs father but am getting no where. Pesticides are hard on any child let alone one with asthma. This has gone on every other week end for 2 years. Please respond. Thank you.

Sounds to me like a hearing on modification of custody might be in order, if that's what you're suggesting you might want.

You have to show a substantial and continuing change in circumstances (such as neglect of a child) that makes such a modification reasonable.

Hope this helps. Let me know if you have other questions. OK?
