Legal Question in Family Law in Indiana

My mom has broken up with her husband and it seems that her marriage of 31 years may be ending. She purchased her home prior to meeting my step father and has since then taken out a second mortgage, thus the house is not paid off yet. She wants to leave the house to my brother and I in the event that she passes away. Could she quit deed the house to me until after the divorce is final, and then I deed it back to her so that my step father won't have any legal right to it?

You rmother needs to talk to a family law attorney about how to protect her rights. If she does as you suggest, it may well mean that the judge will give her less property than she is otherwise entitled to, including the home value.

You definately need to have your mother contact a local attorney before you do anything.
