Legal Question in Family Law in Indiana

The mother of my child,who lives in a different state than me, had her children removed from her home and is being charged with several counts of child neglect. I want to file for Sole custody of my child. What rights will she have to fight it and will the courts allow me to file since my daughter as been temporarily placed in the home of another relative of hers?

She always has the right to oppose it. You always have the right to request custody of your children if you think it is in their best interests.

You should post this question in the state where your child is located as you have not provided enough information for me to know whether you could file in Indiana.
