Legal Question in Family Law in Indiana

If a Mother is incarcerated, can a father sign over custody of the children to a family member without the Mothers consent? Incarceration was for short period of time in county jail - not prison and was not drug/alcohol related charges.

What do you mean by "sign over"? Permanently give the children's custody to a third party? NO Give their care to a 3rd party while mother is in jail? YES Mother needs to talk to her attorney upon release to determine what has been done and what she can do.
