Legal Question in Family Law in Indiana

I am the mother of a three month old little girl! She has my last name and her father is not on the birth certificate. I am planning on taking him to court for child support! When we go to court to my understanding the judge is going to ask each of us if we want her last name changed. What happens if i say no i dont want it to change and he says yes he does want it changed? and will he be put on the birth certificate if he pays child support?

If he wants his last name, the court will usually agree. You should have the birth certificate amended to add him as well as the name change if granted.
