Re: Motion to set aside protective order

If you have a temporary protective order already in place and you fail to show up at the hearing to explain why you do or don't want it to become permanent, the order most likely will be discontinued in your absence.

However, like the Boy Who Cried Wolf, if you ask for a temporary protective order, get it and then fail to show up at the hearing on whether to extend it and then later ask for another protective order, the court isn't going to be all that sympathetic to your plight.

It would be better if you showed up at court and told the court that you feel the tro is no longer necessary and ask that the case be dismissed.

Hope this helps!
