can i move my children, ages 6 and 5, out of state with their step-father and me if their father is barely paying child support and hardly ever see them?

You have to provide notice to their father to give him a chance to object. There is a very specific statute which must be followed for giving that notice, and I recommend the assistance of counsel.

I agree with Jay. You cannot just move. There is a relocation statute that you must follow that provides the steps and rights involved. I blogged about the relocation statute some time ago. Please visit my blog at www.todayslawalert.com
