Legal Question in Family Law in Indiana

move away

this question is similiar to a prior question with a twist, I would like to touch on moving a minor from Indiana to North Carolina. This case has been seen in court with denial given to father on the move, who currently has primary physical custody. He presented the court with need due to aging, ill parents( he is an only child) and acceptance of a position in arelated field. We are now wanting to marry, he still has primary custody and I am located in North Carolina in a job that pays much higher than in Indiana, will the addition of marital status have any effect or will the courts feel that the marriage was only to facilitate the move? We have been involved for many years and I accepted this position prior to the first petittion.

Re: move away

Without knowing why the court denied the petition, your question can not be answered. The fact that he wants to remarry to someone who will be living in N.C. might be helpful. Without a context, I cannot say.

The argument would be stronger if the employment position was for him and for a job that pays substantially less in Indiana or is not available in Indiana.
