Legal Question in Family Law in Indiana
Moving out of state
My ex-husband is planning to move from Cincinnati, Ohio to just across the boarder into Indiana. Our son was told not to tell me anything about this. What, if any, legal rights do I have. We currently have ''shared parenting'' but when this was placed, I did not have any legal representation and felt helpless. Even though it is only across the boarder, are my ex and his wife required by law to inform me of this and give the new address and phone number? I refrained from moving out of town because I was afraid of being taken to court. Could anyone advise me?

Re: Moving out of state
The laws of the state where your divorce occurred determine the procedures used when one parent leaves the jurisdiction of the court. If your former spouse is moving from Ohio to Indiana, I would tend to believe that you were divorced in Ohio and should redirect your question as relating to Ohio law. Indiana has a requirement for divorces which occurred in Indiana to give notice not only to the other parent but also to the court when moving. This does not apply to someone moving here from another jurisdiction.
