Legal Question in Family Law in Indiana
moving to another state...he says no
I want to move to Kentucky with my new boyfriend who is the father of my 5 year old daughter.I now live in Indiana. My ex-boyfriend doesn't want me to take our two boys ages 2 and 3 with me . I have custody because we haven't went to court for custody yet.I need to know what I can do to take them with me across state lines, and if I will be able to move or not? What is legal and what isn't legal?

If no court order exists at this time that restricts your move, you can do so.
However, if there is a case already existing, say for paternity, child support, whatever, in Indiana, you would have to come back here to defend that if he brings action related to those things.
If nothing has ever been filed and he tries to get you to come up here, then you can tell the court that you do not submit to the jurisdiction of the court here, as long as you don't have significant ties to the state.
I would need to know more facts of your case before I could adequately address the jurisdiction issue.
Hope this helps.
