Legal Question in Family Law in Indiana

Non-custodial visitation rights violated

Have visitation rights, live in two different states. Custodial parent not allowing phone calls, verbal communication and demanding non custodial parent to furnish cell phone to child. Also states in writing that child who is 11 has the right not to speak to non-custodial parent. Do not have the money for attorney. How hard is it to represent self in this case and does the non-custodial parent have enough for contempt charges against the custodial parent.

Re: Non-custodial visitation rights violated

You did not say which state the divorce was in. Regardless, I suggest very strongly that you find some funds for an attorney. Since the custodial parent is probably in contempt, you should be able to ask the court for attorneys fees. However, I know of no attorney who takes on these cases without first getting paid by the client. When the court orders the other party to pay attorneys fees, the client receives reimbursementr for attorney fees already incurred.
