Legal Question in Family Law in Indiana

Obtaining Child Custody

Basically, I would like to know how difficult it is for my ex-husband to obtain custody of my children. A bunch of things are being said that I abuse and neglect my children and none of it is true and I would like to know how hard it will be for him to get my children. He says he has X-rated pictures of me and he is going to use them against me to get my children and im not sure what else.

Any information that could be useful would be great. Thank you fro your time.

Re: Obtaining Child Custody

In order for him to win a change of custody battle, he has to prove you "unfit" as a parent.

If you're a crackhead, homeless, or mentally ill and it has affected your parenting, then he might win.

If he has a different style from you and merely doesn't like the way you do things, the court is highly unlikely to change custody.

Another thing: He cannot bring up anything from before the last custody order was entered by the court. He can only bring up things that happened AFTER the court's most recent custody order.

So, if he has some old naked pictures of you from 20 years ago, that's completely irrelevant.

Hope this information helps.
