if a parent is getting divorced and leaves the state is that abandonment if she leaves the kids with the other parent?

Calling something "abandonment" is very rarely relevant. The real questions is what you think you will accomplish by calling the situation "abandonment". Perhaps a posting with the real question might give you the answer you seek.
