Legal Question in Family Law in Indiana
Ok my parents are divorced. My mom is remarried and my father is not. My father is dying and me and my brothers are fighting. I am a girl and im the oldest. There is alittle debate to who would be in charge and who would be the one to have the final say in the decisions regarding our father. Is it me a daughter but the eldest, or my brother who is the 2nd eldest but the eldest son?

Unless your father has a power of attorney, no one does while he is alive unless someone petitions the court for guardianship of the person. Once he passes, if he has a will, the person he designated is in charge once appointed by a judge. If no will, then someone will have to petition the court to be appointed administrator. If your father is well enough to make decisions you should have a social worker and attorney go in to speak with him conerning his wishes.
