My son and his girlfriend have a 2 month old child together. Whenever they argue, she does not allow him to see his child. Both of them are 20 and living with each of their parents. His girlfriends father is carrying insurance on the child and paying most of the expenses while neither of them are employed. There is no child support established at this time either. If they dont have the child at night together, then they usually take turns every other night with him. Is there anything my son can do legally to get to see his son, and can she have the childs last name changed to hers( it's in my sons last name now) without his consent?

The son needs to do one of two things. Get paternity established - this is a legal procedure which must be done through the Grant County juvenile court. Or, he marries the girl. Until one of these is done, he has no parental rights.

Your son should contact an attorney and file for his parental rights in court and child support. Be aware that at this point he is at risk for a number of things, one; the court could order chld support dating back to the birth of the child. The court can do this at any time, so even if there is no order for 5 years for example, he could be ordered to pay 5 years of support. Therefore, he should get these things in order now.
