Legal Question in Family Law in Indiana
Paternity
I have a daughter who is 3 years old, and I had her out of wedlock, but the man i Married signed the papers saying he was the biological father. I am now married, and have been for 2 years. And a man who says he is the father wants to take me to court, even though I know I had sex with only my husband. I just think it is absurd and can't believe someone would want to ruin my life. I just wanted to know if he was allowed to dothat, and if he could if there was ANY way that I could get out of doing it, so I, and my daughter, wouldn't have to deal with false allegations. I hope you understand.

Re: Paternity
Unfortunately, there is no way out of this. The man is entitled to his day in court if he thinks that the child may be his. Based on the facts presented, you have nothing to fear so have DNA testing done. It is a simple test where merely swab the mouths of the three of you and a couple of weeks later you will have the test results and can get on with your lives.
