Legal Question in Family Law in Indiana

paternity

you need more information,, i have been to court with the state over the child support, although i did not know i had a right to ask for paternity, i have 2 children by 2 different women and i was never married, they went on welfare and then they came and looked me up,, i think one of the mothers was already pregnant when i met her, but i could not get anyone to listen to that. i am not a man of much money so i had no attorney, i only had the right to pay.

Then when i went last week to see about a child support order for my daughter and they said i had to prove paternity, i am saying i am her father, yet i have to prove that, when i did not have that option before with the other 2. i do have some court documents that say i am the father and to pay, after the fact, but that still does not mean they are mine, example the man that spent most his life paying for a child that was not his,,,

i just would appreciate any help, because i do feel that i would not be the father for sure on the one that had someone forge my name on the birth certificate, the other maybe 50/50 but i would like to find out for sure.

Re: paternity

If there was fraud, you have the right to ask the court for paternity tests even if your paternity was established by agreement.

Regarding your present situation, you can petition the court to establish paternity. You may be able to have the prosecutor do that for you, since you are seeking seeking support. I am not sure about whether they will, but it seems to me that they cannot discriminate based on sex.
