Pending Personal Injury/Asset?

Ater being married for over 25yrs, my husband has now filed for divorce. Last Feb. he was involved in an auto accident and soon after filed a personal injury case. He was unable to work for several months. Is his pending personal injury case considerd a marital asset? His injury did happen while we were married, as well as the hiring of the attorney to represent his injury case.

To the extent that the case does not involve future income and future medical it might be considered an asset.
