Legal Question in Family Law in Indiana

personal property after divorce

My divorce was final in June 2007. We outlined specifically in our final divorce paperwork signed by the judge that my ex is to be financially responsible for a truck that is in both of our names. He is constantly late with payments or doesn't make them at all, thereby reducing my credit score considerably in the meantime. What recourse do I have? Is there any way to get around this? As of now, he refuses to try and refinance it to get it out of my name... the payoff is $7000.00. Could this be settled in small claims? What can I do to make him take care of this?

Re: personal property after divorce

You should have required the refinancing as part of the divorce. All you can do is file for contempt with the family law court.
